Exclusion of liability
1.14 We do not accept liability for any loss or damage that you suffer as a result of using this website.
1.15 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.
Shipping
1.16 Your order will be processed and delivered without undue delay, no later than 30 days after your order has been placed.Pre-orders have a manufacturing lead time of up to 21 business days.
1.17 Please allow for up to 7 working days for delivery following the dispatch of your order. In the event of a delayed or missing delivery, please use the tracking information to contact the appropriate carrier as in most cases your item is being held at a depot due to the unavailability of a responsible adult to sign for the parcel.
1.18 Please note that we cannot be held liable for delays or non-delivery if the customer address is incorrect. Please ensure you enter the full address and correct postal or zipcode during the checkout process. If your item is returned to us due to incorrect or incomplete address, you may request that your order be reshipped to the correct address. The additional shipping expense will be charged to you. Payment may be made via bank transfer or Stripe; once confirmed, you will receive a new tracking number for delivery.
Cancellations, returns and refunds
1.19 All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.
1.20 Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.
1.21 To meet the cancellation deadline, please notify us via email about cancelling the order before the cancellation period has expired. If your goods have already been despatched your cancellation will be handled as a return and you will be liable to return the goods at your own cost.
1.22 If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the order.
1.23 We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.
1.24 Once you have notified us that you wish to cancel the order, any sum debited to us will be refunded to you as soon as possible and in any event within 14 days of your cancellation.
1.25 You will not have any right to cancel an order for the supply of any of the following goods:
(a) medicinal products or services that are either dispensed on prescription or are available free under an NHS arrangement.
(b) the supply of goods or services where prices are dependent upon fluctuations in the financial markets, which are beyond the control of the retailer.
(c) the supply of goods that are made to the customer's specification or are clearly personalised i.e. bespoke or custom-made products.
(d) the supply of goods for Trichological treatment or therapies.
In addition you will lose your right to cancel if you:
(a) unseal goods that are not suitable for return if they are unsealed, due to health protection or hygiene reasons.
(b) unseal audio, video recordings or computer software that were sealed at the time of delivery.
(c) combine goods with other goods after delivery so that they become inseparable.
(d) have opened and/or used the product.
1.26 Any refunds are processed net the outgoing transaction fees. If your item has been returned to us due to failure to collect or because an incorrect or incomplete delivery address was supplied, we will refund the net cost of the goods and not the outbound shipping costs.
Damaged, Incomplete or Incorrect Orders
1.27 In the unlikely event you receive an incomplete, damaged or incorrect order, you must notify us within 24 hours of receipt. In the event of damage, you must retain all packaging. We require photographic evidence and clear descriptions of the damage or loss sustained (send as many images as you can)- we will then submit a claim to our carrier, as we accept no liability for loss or damage incurred during transit. Once the claim has been heard the item will be credited, refunded or replaced.
You will not incur additional costs for the fulfillment of incomplete orders as long as we have been notified within 24 hours of receipt.
HEALTH & SAFETY
1.28 We do not accept responsibility for the misuse of our products. It is the responsibility of the customer to use the product as directed and check with a professional if in doubt.
By purchasing our products, you acknowledge that we use organic materials and therapeutic grade essential oils and recognise and accept the fact that some ingredients may cause irritation or sensitivity to certain individuals. Almocado will not be held responsible for such occurrences.
Please read the ingredients on the label to ensure you do not have any allergies to our ingredients, you can always email us to make sure as we are happy to customise your order by substituting ingredients for you. If any allergy occurs you discontinue use immediately and seek professional advice. All customers should perform a patch test on their skin before use. We further encourage those with sensitive skin to request unscented products.
Law and jurisdiction
These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
